1. Acceptance of Agreement

These Terms and Conditions constitute a legally binding agreement between you (whether an elected representative, political campaign manager, office staff member, or citizen constituent) and MLA-Connect Labs (operating under adbysms.com).

If you do not agree with all provisions of these terms, you must discontinue the use of our services immediately.

2. Eligibility and User Categorization

To use MLA Connect, you must satisfy the following conditions:

• You are at least 18 years of age and legally competent to enter into a binding agreement.
• If registering on behalf of an elected public official (MLA/MP) or official party office, you warrant that you hold legitimate authority to bind such entity.
• Citizen users accessing the platform to report grievances or engage with their elected representatives agree to provide true, accurate, and current contact information.

3. User Roles & Account Responsibilities

A. Administrative / Representative Accounts

Holders of administrative credentials are solely responsible for safeguarding their login credentials, multi-factor authentication tokens, and ensuring appropriate role-based privileges are assigned to constituency office staff.

B. Citizen & Constituent Interaction

Citizens submit grievances and feedback in good faith. You agree not to misuse complaint ticketing systems for frivolous, malicious, or abusive claims.

4. Permissible Use & Prohibited Conduct

You agree not to use MLA Connect for any prohibited activities, including but not limited to:

• Broadcasting unlawful, defamatory, libelous, harassing, hateful, or communal messages violating the Indian Penal Code or Information Technology Act, 2000.
• Sending unsolicited commercial spam, pyramid schemes, or unsolicited bulk promotions unrelated to genuine legislative or constituency governance.
• Interfering with, disrupting, or attempting to compromise server security, rate-limiting measures, or database architectures.
• Falsely claiming endorsement from or impersonating another public official, government agency, or citizen.
• Uploading files containing viruses, Trojan horses, malware, or corrupted data.

5. Intellectual Property Rights

The MLA Connect logo, trademark, software code, database architecture, design layouts, graphics, and documentation are the exclusive intellectual property of MLA-Connect Labs and adbysms.com.

Constituency reports, work-completed brochures, and visual proof decks generated by users remain the property of the respective representative or office, with a limited license granted to MLA Connect solely to process and deliver such content.

6. Citizen Data & Privacy Protection

We handle all user data in accordance with our Privacy Policy and Indian data protection norms. Users may also request full data erasure under our User Data Deletion Policy.

7. Third-Party Integrations & Messaging Gateways

MLA Connect interfaces with third-party service providers, including cloud hosting providers, telecom operators, and messaging gateways (such as SMS and WhatsApp Business APIs). We are not liable for transient network delays or gateway outages caused by third-party telecom operators.

8. Disclaimers & Limitation of Liability

MLA Connect is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

While our platform streamlines civic issue tracking and status communication, MLA Connect does not adjudicate civic grievances and is not responsible for the speed, method, or outcome of any municipal or governmental administrative action.

In no event shall MLA Connect, its founders, directors, or employees be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use the platform.

9. Termination & Account Suspension

We reserve the right to suspend or terminate access to any account without prior notice if we identify violations of these Terms, abusive use of messaging quotas, unlawful conduct, or security breaches.

10. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal dispute, controversy, or claim arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
